Terms of Use

These Terms of Use ("Terms") govern your use of Voyagekit — the website at voyagekit.app and the Voyagekit mobile app (together, the "Service"). The Service is owned and operated by GearKit AI, LLC ("Voyagekit," "we," "us"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or guardian who agrees to these Terms on your behalf.

Please read the "Disputes and arbitration" section carefully. It requires most disputes between you and us to be resolved through binding individual arbitration instead of in court, and it includes a waiver of class-action and jury-trial rights. You have 30 days to opt out, as described there.

Your account

Some features require an account. Sign-in is handled by our authentication provider, Clerk — you can sign in with your email or with Sign in with Apple. You agree to provide accurate information and to keep it current. You are responsible for keeping your sign-in credentials confidential and for activity that occurs under your account; tell us right away at support@voyagekit.app if you believe your account has been accessed without your authorization. You can delete your account at any time from the app — open Account and tap Delete account — as described in our Privacy Policy.

Guest mode (planning without an account)

You can plan a trip without creating an account. Guest trips are stored against an anonymous guest identifier on your device, and you can later claim them into an account, at which point they become part of that account. Unclaimed guest trips are automatically deleted after 90 days of inactivity, as described in the Privacy Policy. Guest trips exist only on the device that created them until claimed — if you lose the device or clear the app's data before claiming, we may not be able to recover them.

Your content

The trips, itineraries, journal entries, notes, photos, and other material you add to the Service ("Your Content") remain yours. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt (for example, resizing photos or assembling them into a keepsake), and display Your Content — solely to operate, provide, and improve the Service for you and the people you share with. This includes processing Your Content with our service providers as described in the Privacy Policy (for example, our AI provider generates itineraries and keepsakes from what you share). The license ends when Your Content is deleted from the Service, except where limited copies persist briefly in routine backups as described in the Privacy Policy.

You are responsible for Your Content. Only add material you have the right to use and share — including photos of other people, which you should share only with their permission where required.

We may remove content or suspend access that we reasonably believe violates these Terms.

Shared keepsake links

If you create a shareable keepsake link, anyone with that link can view the trip content and photos you included, including any location shown on the keepsake. Links are unlisted (not published or indexed by us) but are not access-controlled unless you set the optional password on a keepsake — anyone you give the link (or, for a password-protected keepsake, the link and the password) can pass it on. Delete the keepsake to revoke access. You are responsible for what you include in a keepsake and for whom you give the link to.

Trip collaboration and invites

You can invite others to a trip; we use the email address you provide to send the invitation, and the trip's content is visible to the collaborators who join. Only invite people you actually want to see and contribute to the trip. Your interactions with other users are between you and them — we are not responsible for other users' conduct or content, though we may (but have no obligation to) step into disputes between users.

Subscriptions

Parts of the Service require a paid subscription (Voyagekit+), purchased as an in-app purchase through Apple's App Store. The price and billing period are shown before you buy. Subscriptions are billed to your Apple ID and auto-renew unless auto-renewal is turned off at least 24 hours before the current period ends. You can manage or cancel your subscription in your device's Settings. Payment, billing, and refunds for in-app purchases are handled by Apple under Apple's terms; we do not process your payment details. Canceling stops future renewals; it does not retroactively refund the current period (Apple decides refund requests). We may change subscription pricing or included features prospectively — changes take effect no earlier than your next renewal, and material changes will be notified in advance.

Privacy

Our Privacy Policy explains what information we collect, how we use it (including how AI is involved), and the choices you have. It is incorporated into these Terms by reference; if these Terms and the Privacy Policy conflict about your personal data, the Privacy Policy controls. We do not use third-party advertising trackers on the Service.

AI-generated travel content

Itineraries, suggestions, and other planning output are generated with AI from the information you and our data sources provide. They are suggestions, not verified facts or professional advice: opening hours, prices, availability, transit times, and safety or entry requirements can be wrong or out of date. Confirm the details that matter — bookings, visas, health and safety guidance — with the venue, carrier, or authority before you rely on them. Your travel decisions, and your safety while traveling, are your own responsibility.

Our license to you; ownership; feedback

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial purposes, subject to these Terms. All intellectual-property rights in the Service itself — its software, design, and content other than Your Content — belong to GearKit AI, LLC or its suppliers; these Terms transfer no ownership to you, and all rights not expressly granted are reserved. If you send us feedback or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback freely, without attribution — please don't send feedback you consider confidential.

Third-party services

The Service works with third parties — for example, Apple (sign-in and in-app purchases), Clerk (authentication), and mapping providers (including OpenStreetMap / CARTO map tiles) — and may link to third-party websites such as venues, booking sites, or articles. We do not control and are not responsible for third-party services; your use of them is governed by their own terms and privacy practices.

Changes to the Service

We may modify, suspend, or discontinue the Service (or any part of it) at any time. We have no obligation to provide support or maintenance, though we try to help — reach us at support@voyagekit.app.

Indemnification

You agree to defend, indemnify, and hold harmless GearKit AI, LLC and its officers, employees, and agents from claims and reasonable costs (including attorneys' fees) arising out of (i) Your Content, (ii) your use of the Service, (iii) your violation of these Terms, or (iv) your violation of applicable law. We may assume control of the defense of any such claim at your expense, and you agree to cooperate and not to settle such a claim without our prior written consent.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, GEARKIT AI, LLC AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE. WHERE APPLICABLE LAW REQUIRES WARRANTIES, THEY ARE LIMITED TO 90 DAYS FROM YOUR FIRST USE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) GEARKIT AI, LLC AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY LOST PROFITS, LOST DATA, COSTS OF SUBSTITUTE PRODUCTS, OR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SERVICE; AND (B) OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS IS CAPPED AT THE GREATER OF (i) $50 USD AND (ii) THE AMOUNT YOU PAID US UNDER THESE TERMS IN THE SIX MONTHS BEFORE THE INCIDENT GIVING RISE TO THE CLAIM. MULTIPLE CLAIMS DO NOT INCREASE THIS CAP. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Term and termination

These Terms apply while you use the Service. We may suspend or terminate your access (including deleting your account) at any time, including if we believe you have violated these Terms. You can stop using the Service — and delete your account in the app — at any time. Provisions that by their nature should survive termination (including ownership, disclaimers, liability limits, indemnification, and the dispute terms) survive.

Disputes and arbitration

Please read this section carefully — it affects your legal rights, including your right to sue in court and your right to a jury trial.

Agreement to arbitrate

Except as described below, you and GearKit AI, LLC agree to resolve all disputes arising out of or relating to the Service or these Terms through binding individual arbitration, not in court. Exceptions: (i) individual claims that qualify for small claims court; and (ii) requests for equitable relief related to intellectual property. This agreement applies to claims that arose before you agreed to these Terms.

Try to resolve it first

Before starting arbitration, the party raising the dispute must send written notice to the other — ours goes to support@voyagekit.app. Within 45 days of that notice, the parties will confer in good faith by phone or video. If the dispute isn't resolved within 60 days, either party may start arbitration.

Arbitration rules

Arbitration is administered by JAMS (jamsadr.com) — claims under $250,000 under JAMS' Streamlined Arbitration Rules, larger claims under its Comprehensive Rules. Unless the parties agree otherwise, arbitration is conducted in the county where you live. Arbitration materials are confidential. The arbitrator may award the same relief as a court, on an individual basis only; the award is final and binding. Courts (not the arbitrator) decide challenges to the class-action waiver below. Each party bears its own attorneys' fees unless the arbitrator finds a claim frivolous. If 100 or more substantially similar demands are filed against us within 30 days by the same firm or coordinated group, JAMS will batch them (groups of 100, one arbitrator and one set of fees per batch).

Waivers and opt-out

BY AGREEING TO ARBITRATION, YOU AND GEARKIT AI, LLC WAIVE THE RIGHT TO A TRIAL BY JUDGE OR JURY, AND ALL DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS — NEITHER PARTY MAY BRING A CLAIM AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, REPRESENTATIVE, OR COLLECTIVE PROCEEDING. If a court finds the class-action waiver unenforceable for a specific claim, that claim may be litigated in court in California; all other claims remain in arbitration. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@voyagekit.app with your name and a clear statement that you wish to opt out. If any part of this section is found invalid, it is modified to the minimum extent necessary and the rest remains in effect.

State-specific notices

California

Under California Civil Code Section 1789.3, California users are entitled to this notice: the provider of the Service is GearKit AI, LLC; to file a complaint or request further information, contact us at support@voyagekit.app, or contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 N. Market Blvd., Suite N112, Sacramento, CA 95834, or (800) 952-5210. California residents also have the privacy rights described in our Privacy Policy.

Nevada and other states

Nevada residents may direct us not to sell certain covered information (we do not sell personal information) by emailing support@voyagekit.app. Residents of Colorado, Connecticut, Virginia, and other states with comprehensive privacy laws have the rights described in our Privacy Policy.
